Terms & Conditions
These Terms & Conditions (“Terms”) govern your access to and use of the MyLumera Technologies platform, websites, and products (collectively, the “Services”). By registering for, accessing, or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.
Acceptance and eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding contract. If you are using the Services on behalf of an organization, you represent that you have authority to bind that organization. Your use of the Services is also subject to our Privacy Policy and, where applicable, a Data Processing Agreement.
Accounts and responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must promptly notify us of any unauthorized use. You agree to provide accurate, current, and complete information during registration and to keep it updated. Administrators are responsible for managing users, roles, and access within their workspace.
Acceptable use
You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not: (a) reverse-engineer, decompile, or disassemble any part of the Services; (b) attempt to gain unauthorized access to systems or data; (c) transmit malware, spam, or harmful code; (d) interfere with the integrity or performance of the Services; (e) use the Services to store or process data in violation of any law, including the Data Privacy Act; or (f) sublicense, resell, or commercially exploit the Services without authorization.
Intellectual property
MyLumera Technologies retains all rights, title, and interest in and to the Services, including all software, designs, trademarks, and content. You retain ownership of your data. We grant you a limited, non-exclusive, non-transferable license to use the Services during the term of your subscription. Feedback you provide may be used to improve our products without obligation or compensation.
Subscriptions, billing, and termination
Services are provided on a subscription basis. Fees are billed in advance and are non-refundable except where required by law. We may suspend or terminate your access for non-payment or violation of these Terms. Upon termination, your data will be retained for a reasonable period and then deleted in accordance with our Privacy Policy and applicable legal obligations. You may export your data before termination.
Disclaimer and limitation of liability
The Services are provided “as is” and “as available” without warranties of any kind, either express or implied, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted or error-free. To the maximum extent permitted by Philippine law, MyLumera Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data loss, arising out of or related to your use of the Services. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify and hold harmless MyLumera Technologies and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses arising from your use of the Services, your violation of these Terms, or your infringement of any third-party right, including intellectual property or privacy rights.
Modifications to terms
We may update these Terms from time to time. Material changes will be communicated via email or through the platform at least thirty (30) days before they take effect. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.
